5. OUR LEGAL BASIS FOR PROCESSING
Depending upon the circumstances, our legal basis may include:
Steps at Your Request Before Entering a Contract
Where you ask us to assist you with a particular recruitment opportunity or service.
Legitimate Interests
We may process candidate information where necessary for our legitimate interests in operating a specialist recruitment business, maintaining a professional talent network and matching suitable candidates with potential employers.
When relying upon legitimate interests, we consider your interests, rights and freedoms.
Consent
We may rely upon your consent where this is appropriate or legally required.
You may withdraw consent where processing is based upon consent.
Legal Obligations
We may process information where necessary to meet legal or regulatory requirements.
6. SPECIAL CATEGORY INFORMATION
Recruitment does not generally require us to collect sensitive personal information unless it is genuinely relevant and lawful to do so.
Please do not include unnecessary information concerning matters such as health, religion, political opinions, sexual orientation or other special-category information in your CV or candidate registration.
If special-category personal data becomes relevant to a recruitment process, it will only be processed where an appropriate legal basis and condition exists.
7. SHARING YOUR INFORMATION WITH EMPLOYERS
A central part of our recruitment service involves introducing suitable candidates to potential employers.
Where appropriate, information shared may include:
your CV;
professional experience;
qualifications;
skills;
relevant career preferences;
availability;
references or reference information where appropriate; and
other information relevant to the role.
We will not ordinarily send your CV or identifiable candidate profile to a prospective employer without discussing the opportunity with you first.
This is an important part of the Percival Equi approach.
We recognise that many candidates are currently employed and require discretion.
8. CONFIDENTIAL SEARCHES
Some recruitment assignments may be confidential.
Likewise, candidates may wish their job search to remain confidential.
We will take reasonable steps to respect confidentiality requirements communicated to us.
However, candidates should understand that information must necessarily be shared with relevant parties at certain stages if they wish to proceed with an employment opportunity.
9. REFERENCES
We will ordinarily seek references at an appropriate stage of the recruitment process rather than automatically contacting referees when you first register.
Where appropriate, we will discuss reference checking with you before contacting your current employer.
We recognise the sensitivity of contacting a current employer without a candidate's knowledge.
10. INTERNATIONAL OPPORTUNITIES
Professional equestrian careers are international.
If you wish to be considered for positions outside the EEA, it may be necessary to transfer certain personal information to an employer or organisation in another country.
Where applicable, we will take appropriate steps required by data protection law in connection with international transfers.
We will also aim to ensure that you understand where your information is being sent as part of a recruitment process.
11. RIGHT-TO-WORK INFORMATION
For international or cross-border appointments, employers may require evidence concerning nationality, visas, work permits or right-to-work status.
Percival Equi may process information relating to these matters where reasonably necessary for recruitment.
Final responsibility for verifying an employee's legal entitlement to work remains subject to applicable law and the relevant employer's obligations.
12. HOW LONG WE KEEP CANDIDATE INFORMATION
Equestrian careers develop over time, and candidates may wish to hear from us about opportunities long after initial registration.
We may therefore retain candidate information while you remain part of the Percival Equi professional network and while there is an appropriate lawful basis for doing so.
We will periodically review candidate records.
Where appropriate, we may contact you to confirm whether:
your information remains accurate;
your circumstances have changed; or
you wish to remain within our candidate network.
You can ask us at any time to stop contacting you about recruitment opportunities or request deletion of information where the right to erasure applies.
Certain information may need to be retained for legal, regulatory, contractual or legitimate business reasons.
13. KEEPING YOUR PROFILE CURRENT
Candidates are encouraged to tell us when important information changes.
For example:
new employment;
additional qualifications;
new international experience;
changes in availability;
changes in preferred location;
changes in career objectives; or
updated contact details.
Accurate information helps us identify opportunities that are genuinely relevant to you.
14. AUTOMATED DECISION-MAKING
Our recruitment philosophy is based upon understanding people rather than simply matching keywords.
Percival Equi does not intend to make decisions that have legal or similarly significant effects on candidates solely through automated processing.
Technology may assist us in organising or searching candidate information, but suitability assessments and introductions are intended to involve human professional judgement.
15. YOUR RIGHTS
Subject to applicable law, you may have rights including:
access to personal information held about you;
correction of inaccurate information;
erasure in certain circumstances;
restriction of processing in certain circumstances;
objection to certain processing;
data portability where applicable; and
withdrawal of consent where consent is relied upon.
You may also lodge a complaint with the relevant data-protection supervisory authority.
In Ireland, this is the Data Protection Commission.
16. REMOVING YOURSELF FROM OUR CANDIDATE NETWORK
If you no longer wish to be considered for opportunities through Percival Equi, simply contact us at:
hello@percivalequi.com
We will stop using your information for active recruitment purposes, subject to any information we are entitled or required to retain.
17. SECURITY
We take reasonable technical and organisational measures designed to protect candidate information against unauthorised access, disclosure, loss, alteration or misuse.
Because candidate CVs contain substantial personal information, we encourage candidates not to include unnecessary sensitive personal details.
18. CHANGES TO THIS NOTICE
We may update this Candidate Privacy Notice as our recruitment services, technology or legal obligations develop.
The current version will be available on our website.
